This paper analyzed present situation and the problems of intellectual property protection of classical prescriptions in our country and investigated the reasons for the difficult in intellectual property protection of classical prescriptions, in hope to construct a special protection system of the subject of rights, the right to object and the establishment of benefit sharing mechanism.
