| 文章从中药经方的概念与特点入手，分析了我国经方及其法律保护的现状，并对我国现行知识产权法律保护体系难以有效保护中药经方的原因进行了分析，试图明确经方的权利主体、权利客体，建议通过建立健全经方传承人的惠益分享机制等来建构我国中药经方的法律保护体系。 |

| This paper analyzed present situation and the problems of intellectual property protection of classical prescriptions in our country and investigated the reasons for the difficult in intellectual property protection of classical prescriptions, in hope to construct a special protection system of the subject of rights, the right to object and the establishment of benefit sharing mechanism. |
